Terms of Service

By transferring payment it is understood that you agree to and have read these terms of service.I, as the artist, reserve the right to decline any commission request. At this time, I am not taking any commissions that include adult content to comply with Ko-fi’s ToS.

Payment

- Payment is made through Ko-fi and billed to my company Rendered Palates, LLC.
- Payment must be made before the Artist starts working on commission.
- At least one sketch will be shown before coloring and final rendering.
- Adjustments can be made after the final sketch within reason.
- Refunds may be issued in the event the Artist cancels the commission prior to starting.

Distribution Rights

- The Artist has full rights to reproduce the art as seen fit (i.e. selling of prints, portfolio, book of works). All credit for the character design, character, or features will be given to the Client. Any alterations made to the final Commission (removing of signature, recoloring) are prohibited, unless the Artist gives written permission.- Should the Client decide to re-post the commissioned piece/pieces elsewhere, reasonable credit must be given to the Artist. Signature must be visible and unaltered.- The Client is allowed to use commissioned pieces for non-commercial/non-profit uses such as icons, physical prints, digital and physical stickers, social media banners.- A Client can request a commission piece to be private. Private commissions will not be utilized for advertising or displayed on the artist’s social media.- Commissions do not include access to the original files (.psd or .procreate).- Commercial licensing can be available at an additional fee which may include royalties.- All rights not otherwise expressed in these terms are reserved to the Artist.

Bases

- Bases or templates are defined as layered image files that can be altered and colorized after purchase. Bases are not considered a commission. Example images from the listing are not included in the purchase of the base.- Bases must retain the signature when posting. An image uploaded as a profile picture or icon for an account does not need the signature to be visible in the profile picture.- Commissioned bases in which additional line art or details have been made by myself can be included in future updates to bases I upload. The Client’s character will not be redistributed, only commonly available details that are not specific to the character will be selected.- The Artist reserves the right to update bases as needed. This may include additional designs added to the file. Customers who previously purchased a base will be given access to updated files at no additional cost.- Unless stated in the store listing for the base, commercial redistribution such as through use of paid adopts is not permitted. Only the initial buyer has the license for the file.- Bases are not eligible for refunds.

Use

Use of my artwork for the purpose of training large language models, image generation tools, non fungible tokens, or cryptocurrency is prohibited, regardless of if the use is for profit or not.Additional time may be needed depending on species and complexity of design (clothing, patterns, props, etc.).Reference sheets, images, and mood boards can significantly reduce turnaround time.
